TSA Extends Comment Period for Renewed Information Collection Request

On January 26, 2012, the Transportation Security Administration (TSA) published a notice in the Federal Register regarding an approved Information Collection Request (ICR). On March 29, 2012, the TSA announced that it had forwarded the ICR to the OMB for review and approval while extending the comment period by another 30 days.

The ICR stipulates that Aircraft operators must adopt and implement a TSA-approved security program requiring aircraft operators to maintain and update records to ensure compliance with security provisions outlined in 49 CFR § 1544. TSA-approved security programs aim to protect persons and property traveling on flights provided by the aircraft operators against acts of criminal violence, aircraft piracy, and the introduction of explosives, incendiaries, or weapons aboard an aircraft. Aircraft operators are required to submit security program amendments to TSA and make them available for inspection by TSA to ensure transportation security and regulatory compliance.

TSA requires aircraft operators to submit the following information: a master crew list of all flight and cabin crew members flying to and from the United States; the flight crew list on a flight-by-flight basis; passenger information on a flight-by-flight basis; total amount of cargo screened; and total amount of cargo screened at 100%. This information may be provided electronically or manually.

TSA is now soliciting comments to evaluate whether the proposed information collection is necessary for the proper performance of the functions of the agency, including whether the information will have practical utility to: (1) evaluate the accuracy of the agency’s estimate of the burden; (2) enhance the quality, utility, and clarity of the information to be collected; and (3) minimize the burden of the collection.
